Persons who are required to leave the country and who are under a tolerated stay order and would like to do an apprenticeship may be able to obtain a so-called Ausbildungsduldung. Certain requirements must be met for this. It is also possible for people in the asylum procedure who are in training and whose asylum decision is negative during the training period.
Anyone with a tolerated stay for training cannot be deported for the duration of their training. It also opens the way to a residence permit.
The basic requirement for obtaining a tolerated stay permit is a training contract or confirmation of enrolment at a vocational school. The training must be qualified vocational training, i.e. it must last longer than 2 years and lead to a state-recognized or comparable qualification. A dual course of study leading to a university degree and vocational qualification is also an option. Shorter assistant or helper training is also possible if subsequent training in a shortage occupation, e.g. in the care sector, has already been secured.
Persons with toleration status are subject to a pre-tolerance period of 3 months before they can start training. For people who started their training during an ongoing asylum procedure that has ended in a negative outcome, there is no period of prior toleration. They should apply for a tolerated stay for training purposes as soon as possible after receiving the rejection notice.
A clarified identity, e.g. in the form of a valid passport or other identity document with a photograph, is also a mandatory requirement.
NOTE: The application for a tolerated stay for training purposes can be approved up to 6 months before the start of training. The Ausbildungsduldung will then already have a protective effect against deportation.
All persons who are subject to a work ban are excluded from the "Ausbildungsduldung". This includes people whose identity has not been clarified, people whose deportation is not possible for reasons for which they are responsible and people who have only entered the country to receive social benefits. Tolerated persons who come from a so-called safe country of origin are also included.
The tolerated stay for training is excluded if the identity is unclear. This must also be clarified within the first 6 months of entry.
A tolerated stay for training will also not be granted if specific measures have already been initiated to terminate the stay .
Furthermore, the tolerated person must not have any links to extremist or terrorist organizations and must not have committed any significant criminal offences.
The training permit is valid until the end of the training. It can be extended by up to 1 year if, for example, the final examination has not been passed.
If the training is discontinued, the training toleration is valid for a further 6 months to enable you to look for a new training position.
ATTENTION: The foreigners authority must be informed of the discontinuation of training. The training company is also obliged to do so.
If there is no immediate employment after the successful completion of the training, the training toleration can be extended by a maximum of 6 months in order to look for qualified employment.
If employment is found in an occupation corresponding to the training qualification, a follow-up title to the training toleration permit is a residence permit for qualified tolerated persons for the purpose of employment is available.
