Residence requirements generally apply to people who have a temporary residence permit or tolerated stay permit. However, people with a residence permit for humanitarian reasons may also be subject to a residence requirement.
If a person is subject to a residence requirement, they are obliged to take up and maintain their residence at a specific location. Accordingly, they may not move until the residence requirement has been changed or removed.
The change/deletion of the residence requirement can be made upon application if certain conditions are met. For this purpose, an application must be submitted to the Foreigners and Asylum Office. This can be done online or using a form.
When a residence permit is issued on humanitarian grounds, it is often accompanied by a residence requirement. The residence requirement can be lifted by the immigration and asylum authority under certain conditions.
If you are assigned to the district of Central Saxony by the Saxony State Directorate, you are already subject to a residence requirement for the district of Central Saxony if you are unable to secure your livelihood independently at the time of the assignment decision (§ 60 Para. 1 S. 1 AsylG)
As the Aliens and Asylum Office is obliged to accommodate you, it will also impose a residence requirement for a specific accommodation or apartment on the day you are assigned to the district of Central Saxony.
The residence requirement can be lifted or changed under certain conditions.
If you would like to move to a place in the district of Central Saxony, the Foreigners and Asylum Office will decide on your application. If you would like to move to a place that is not in the district of Mittelsachsen, the competent authority of the federal state to which you would like to move will decide on your application.
If your asylum application has been rejected with final or binding effect, the previous residence requirement expires. At the same time, a new residence requirement will be imposed by law for the district of the immigration authority in which you are legally resident at that time if you are unable to support yourself independently at that time.

The residence requirement can be lifted or changed by the Immigration and Asylum Authority under certain conditions. This usually requires the consent of the immigration authority in whose district you wish to move.
The conditions under which a residence requirement can be changed or canceled initially depend on your residence status. There are different legal requirements depending on your residence status. A change/removal of the residence requirement can be considered in particular if you are able to secure your livelihood independently on a permanent basis or if you are moving in with members of your nuclear family (e.g. spouse, biological children).
Section 2 (3) AufenthG is used to determine whether your means of subsistence are secure.
According to this, your livelihood is secured if you are able to cover it, including adequate health insurance cover, without recourse to public funds. The decisive factor in assessing whether you are able to support yourself is whether you are entitled to social benefits. It is irrelevant whether you actually claim them.
Moreover, it is generally only fully secured if the livelihood of all family members is also secured.
Furthermore, it is only assumed that your livelihood is secured if it can be expected to be sustainable, i.e. likely to continue in the future. To assess this, the Immigration and Asylum Office will look at your previous education and employment history. If, for example, you are still in the probationary period of your employment relationship, the authorities will usually wait and see whether you pass this first.
