In accordance with Section 5 of the Asylum Seekers' Benefits Act (AsylbLG), work opportunities are to be made available in shared accommodation for the maintenance and operation of the facility. This excludes activities for the self-sufficiency of the person entitled to benefits.
In addition, as far as possible, work opportunities should be made available with state, municipal and non-profit organizations if the work results serve the general public.
Work opportunities also serve as an opportunity for migrants to gain initial work and integration experience in Germany and to promote their participation in society.
The areas of work can also be based on the interests of the participants.

Operators of facilities for the accommodation of refugees and state, municipal or non-profit organizations in the district of Central Saxony can be responsible for the measures.
Suitable participants are those who are able to work and not in gainful employment and who are entitled to benefits under the Asylum Seekers Benefits Act and are no longer of school age.
The providers of the measures are generally responsible for acquiring participants themselves. The Foreigners and Asylum Office can provide support and arrange contacts if necessary.
In the case of measures to which the participants are obliged by the Foreigners and Asylum Authority, the Foreigners and Asylum Authority is responsible.
AGHs can start at any time of the year. The working hours of 20 - 25 hours per week should be adhered to. If funding is provided for the provision of AGH in accordance with the Municipal Integration Work Ordinance (KomIntAVO) , the application conditions must be observed.
Organizers of the measures must submit an "Application for employment of a participant in an internal or external work opportunity in accordance with § 5 AsylbLG" to the Foreigners and Asylum Office - Accommodation and Integration Department - of the district of Central Saxony. The application must be submitted at least 14 days before the start of the work opportunity.
If the application is approved, a participation agreement must be concluded between the provider of the measure and the participant. The provider of the measure pays EUR 0.80 per hour for the work to be performed, unless the person entitled to benefits can provide evidence of higher necessary expenses incurred by him/her as a result of the work opportunity in the individual case. If the participant has a bank account, payment can be made to this account. However, persons entitled to benefits under the Asylum Seekers Benefits Act have a so-called payment card to which no bank transfer is possible. In this case, payment in cash is required.
There is also the possibility of an obligation on the part of the person entitled to benefits to participate by the immigration and asylum authority.
In addition, the providers also have the option of applying for funding in accordance with § 11 Paragraph 4 Number 4 via the Municipal Integration Work Ordinance (KomIntAVO). Funding of up to a maximum of EUR 500 can be applied for per measure. The number of people who are to be involved in the measure is irrelevant. Recipients of funding from the KomIntAVO can be operators of facilities for accommodating refugees in the district of Central Saxony. State, municipal and non-profit organizations can also apply for funding.
Within this funding, personnel costs for instructors and material costs (materials, work clothing or tools) can be reimbursed, for example. The EUR 0.80 expense allowance is not eligible for funding under Section 11(4)(4) KomIntAVO!
The application for funding must also be submitted to the Foreigners and Asylum Office - Accommodation and Integration Department - of the district of Central Saxony. The application for funding must be submitted four weeks before the start of the measure. Applications for the current year can be submitted until September 30 .

Work opportunities do not constitute an employment relationship subject to social security contributions. Employee rights therefore do not apply.
There is no entitlement to sick pay. However, the statutory regulations on incapacity for work are applied analogously. This means, in particular, that if participants are obliged to take part in a measure by the Foreigners and Asylum Office, they must sign off in good time before the start of the working day. If the incapacity to work lasts longer than three calendar days, a medical certificate of incapacity to work (AU) must be submitted on the fourth day at the latest.
The provider of the measure must inform the Immigration and Asylum Authority immediately if participants are absent without excuse or break off the work opportunity without authorization. If it is no longer possible to continue the work opportunity as a result, the Immigration and Asylum Authority may examine and initiate a restriction of entitlement.
Even in the case of voluntary participation, it can be agreed that in the event of absence due to illness, a deregistration from the measure provider will take place. There are no sanctions in this case. However, the provider can terminate the measure.
With regard to accident protection , the regulations on occupational health and safety and the principles of limitation of employee liability apply accordingly. Instruction in this regard must be provided by the sponsor of the measure before the start of the activity. The Foreigners and Asylum Office can provide support in this regard.
There are no notice periods. The measure can be terminated at short notice. If the measure is carried out on a voluntary basis and only a permit has been issued by the Immigration and Asylum Authority, the sponsor of the measure can cancel the participation agreement if the participant is not suitable. In this case, the Foreigners and Asylum Office must be informed.
If persons have been obliged to take part in the measure by notice, termination must always be agreed in advance with the Immigration and Asylum Authority. If a person is inappropriately conspicuous or does not participate regularly, a restriction of entitlement may be examined and initiated. If the person is not professionally suitable, the obligation can be revoked.
There is no entitlement to leave. Participants can be released from the measure if there are important reasons. This must be agreed in advance with the Foreigners and Asylum Office. In the case of voluntary participation, leave of absence must be agreed individually with the provider of the measure.
A work opportunity does not entitle the participant to continued employment. If a participant performs well and is suitable for employment subject to social security contributions from the perspective of the provider, there is of course the option of making a regular job offer following the measure. This is the responsibility of the sponsor.
